Although the Fourth Amendment provides that “the right of the people to be secure against unreasonable searches and seizures, shall not be violated” defendants involved in criminal prosecutions in state courts have not always been able to exclude illegally obtained evidence. Then, there was Mapp v. Ohio, which changed everything.
