Evidence from crime scenes is being thrown out due to violations of the fourth amendment’s guarantee against unreasonable searches and seizures. Improper collection is too commonplace within our justice system. There is nothing more unjust than seeing an offender go free not because of lack of evidence at the scene of the crime, but rather because the evidence is inadmissible due to how it was seized. This presentation will examine the convergence of the cyber crime scene and the fourth amendment, specifically the procedures for securing and preserving computer evidence and the ramifications for Homeland Security agencies responsible for cyber security.
